Enforcement Actions for Intellectual Property Rights Infringements Claims

I. Overview

ippipk.comis committed to the protection of intellectual property rights ("IPR"). Unauthorized publishing of information and selling or offering for sale of products that may infringe IPR of others are strictly forbidden.

If users publish information violating IPR of others, sell or offer for sale of products infringing IPR of others, they may receive complaints from IPR owners or may be reported.  ipipk.com  will also randomly examine information posted on company profile, product details, product name etc. In case of suspected infringement, the relevant information and product listings will be rejected or deleted. Also, penalty will be imposed in accordance with the types of infringements.

Copyright Infringement

Unauthorized publishing, reproducing, selling or offering for sale of any copyrighted products (including but not limited to books, texts, images, electronic publications, audio work, visual work, software, art craft) as well as unauthorized and improper use of copyrighted materials.

Some of the typical scenarios are listed below for illustration (Please visit FAQ for further information).

1) posting or selling of a product or its packaging, which is a reproduction of copyrighted materials.

2) posting or selling of a product or its packaging, which contains unauthorized use of copyrighted materials while the product or its packaging is not a reproduction of copyrighted materials;

3) unauthorized use of copyrighted image on the Product Detail Page;

4) unauthorized use of copyrighted text on the Product Detail Page.

3)  Membership termination when 48   penalty points are deducted.

Patent

Infringement

Serious violation: To be determined on  a case-by-case basis.
Membership termination upon three violations.
General violation: Unauthorized posting,   selling or offering for sale of products incorporating patented work (including   design patent, utility model, invention etc.), as well as other unauthorized and improper use of patent of others.

1)  No penalty point will be deducted for the first violation;

2)  6 penalty points will be deducted for each repeat violation;

3)  Membership termination when 48   penalty points are deducted.

1. A will impose penalty on users in accordance with the status of the content being complained when the infringement complaint is accepted.

2. No more than 6 penalty points will be deducted within the same day for the "same established copyright infringement", "same established general violations of trademark infringement" or "same established general violations of patent infringement". The "same established copyright infringement" means complaints   filed by the same IPR owner in which no counter-notice is submitted within the   prescribed period or the counter-notice(s) submitted is/are rejected.  The "same established general violations   of trademark infringement" or the "same established general violations   of patent infringement" means complaints filed based on the same IPR in which   no counter-notice is submitted within the prescribed period or the counter-notice(s)   submitted is/are rejected. 

3. Within 5 days from the date on which the first complaint is received, all general violations of trademark/patent infringement complaints against the same user based on the same IPR shall be counted as one complaint.  Within 5 days from the date on which the first   complaint is received, all copyright infringement complaints filed by the same   IPR owner against the same user shall be counted as one complaint.

4. Within 3 days from the date on which the first complaint is established ("established" means after a user received an infringement complaint, no counter-notice is submitted within the prescribed period or the counter-notice(s) submitted is/are rejected), all types of established serious violations shall be counted as one serious violation.

5.  ipipk.com will impose penalties for violations detected during random examination:

(1) For general violations of trademark infringements, copyright infringements, and patent infringements that have not been rectified within 7 days, the product will be taken offline, and 2 penalty points will be deducted for each violation detected while no more than 6 penalty points will be deducted within the same day;

(2) For serious violations of trademark infringements, copyright infringements, patent infringements, intentional infringements (including but not limited to avoiding platform regulation, repeated infringement, well-known rights infringement, etc.), infringements with high regulatory or public opinion risks, or infringements in other sensitive situations, ipipk.com will take offline these products immediately. In addition, ipipk.com will delete these products if they are not rectified within 7 days. For these serious violations, 4 points will be deducted each time, and no more than 12 points will be deducted within one day; 

(3)For merchants who have been pushed many times by "Issue Radar" in one quarter, ipipk.com will deduct 6 further penalty points.Furthermore, ipipk.com will impose additional penalties in the event of other serious infringements. These penalties include deleting products, applying a strike policy, escalating penalty points, blocking stores, restricting access to website functions, freezing accounts, or closing accounts.

6. Infringement may take place in the following: including but not limited to product information (title, attribute, detailed description, picture, video, etc.), store information (store name, decoration, etc.), interactive messages, transactions, reviews, and disputes process. For infringements taking place in each of the situation listed above, separate   penalty will be imposed and such penalties are cumulative.

7. ipipk.com has the right to impose penalties, due to the user’s violations of rules or infringing acts, on the user’s product listings and stores, including but not limited to (i) deduction of penalty points; (ii) rejection, removal or deletion of product listing/information; (iii) restrictions on publishing products listings; (iv) suspension of accounts; and (v) termination of accounts.  For any terminated account, ipipk.com has   the right to take appropriate measures to prevent the user from registering another   ipipk.com account, or selling or offering for sale of products on ipipk.com.

8. Under the following circumstances, in its sole discretion,   ipipk.com reserves the right to unilaterally terminate membership agreement   or service contract, to freeze the user's funds with ipipk.com, in whole or   in part, to directly terminate user’s accounts and related accounts, and/or to   implement other measures that ipipk.com considers appropriate:

  • Where the user has conducted grievous act(s) such as repeated infringing acts, offering for sale of counterfeit products using evasive measures, providing false certifications etc.;

  • Where litigation(s) has/have been initiated or legal demand(s) has/have been requested by IPR owner(s) against/to ipipk.com;

  • Where IPR owner(s) has/have initiated legal action(s) against the user due to its infringing act(s) or the user is being investigated by judiciary, enforcement or administrative authorities;

  • Request(s) from judiciary, enforcement or administrative authorities to terminate any account or to take any relevant measures;

The definition of offering for sale of counterfeit products using evasive measures is as follows: "Sellers deliberately hide or conceal related product information, including but not limited to hiding violating product information, or using other means to evade the platform's supervision of the sale of infringing goods (including but not limited to deliberately blocking trademarks, smearing trademarks or logos, selling products by using marks or logos which confuse consumers, or use hidden links to sell infringing goods)."

9. All violations shall be recorded for 365 days from the date on which the penalty is imposed.

10. ipipk.com reserves the rights of final interpretation and decision and all relevant rights thereof.

11. ipipk.com reserves the right to amend these rules in accordance with applicable laws and regulations, changes in business environment or other relevant factors and will announce the same. The amended version of these rules will come into force as of the date specified in the announcement.

12. These rules are an integral part of all the rules on ipipk.com.  In case of any inconsistency between these rules   and the other rules on ipipk.com, the rules in this document shall prevail.  For any matters not covered herein, the other   rules on ipipk.com shall apply.

13. In the event of inconsistency, ambiguity or conflict between the Chinese and the non-Chinese version of these rules, the Chinese version shall prevail. 

 

III.Our Suggestions to Sellers:

1. Respect IPR.  

Sellers should immediately and diligently check your published and removed product listings.  If there is any infringing act, please delete the infringing product(s) at once.  Also, please closely manage the sourcing process of your products to avoid products with unknown origin.  We recommend using pictures of the actual products and improving the picture quality so that buyers can intuitively understand the products which could lead to more orders being placed.

2. Develop high- quality own brands.  

If your products are of high quality, you may consider developing your own brands and working with the platform to expand the influence of your brands so as to globalize your own branded products and to continuously increase your added value.

3. File intellectual property qualifications in time.  

Please complete the brand qualification filing before posting branded products.  Do not post branded products if you are yet to be authorized to do so.
